Terms of Service
These terms describe baseline rules for Formerie accounts, APIs, SDKs, hosted forms, customer content, delivery channels, and responsible platform use.
Agreement scope
These Terms of Service describe baseline rules for accessing and using Formerie websites, customer applications, APIs, SDKs, hosted forms, embedded forms, documentation, and related services.
If a customer has a signed order form, data processing addendum, service agreement, or other written contract with Formerie, that agreement may contain additional or different terms. If there is a conflict, the signed agreement should control for that customer to the extent stated in the agreement.
This page is launch-surface policy copy and should be reviewed by qualified counsel before paid production launch.
The service
Formerie provides software for creating form endpoints, publishing hosted or embedded forms, receiving website submissions, applying server-side validation and delivery policy, storing operational records, and routing configured messages or events through approved providers.
The service is designed so public browser clients submit allowed form fields, verification tokens, and safe metadata only. Public clients must not choose recipients, provider credentials, email templates, or server-side delivery rules.
Accounts and organizations
You are responsible for maintaining accurate account information, protecting credentials, limiting access to authorized users, and promptly removing users who should no longer have access.
Actions taken through an account or organization may affect forms, domains, published versions, submissions, delivery configuration, provider settings, API keys, audit records, and billing. You are responsible for activity under your account except to the extent caused by Formerie’s breach of these terms or applicable law.
Customer content
Customer content includes form configuration, submitted form fields, uploaded files, delivery configuration, templates, domains, support materials, and related data provided to or processed through the service.
As between Formerie and the customer, customer content remains the customer’s content. The customer grants Formerie the rights needed to host, process, transmit, store, display, secure, troubleshoot, back up, and otherwise operate the service.
Customers are responsible for customer content, including its legality, accuracy, collection notices, consent or other legal basis, retention decisions, recipients, and use of integrations.
Acceptable use
You must use the service lawfully and responsibly. You must not use Formerie to send spam, phishing, malware, deceptive content, unlawful content, harassment, abusive messages, or content that violates the rights of others.
The Acceptable Use Policy applies to all use of the service.
Sensitive and regulated data
Do not use Formerie to collect highly sensitive or regulated data unless Formerie has explicitly agreed to the use case in writing and appropriate contractual, legal, and technical controls are in place.
Examples may include payment card data, government identifiers, health information, biometric information, criminal records, authentication secrets, or children’s information.
Customer websites and forms
Customers are responsible for the websites, applications, forms, notices, and workflows they connect to Formerie.
Customers must not misrepresent their relationship with Formerie, hide required notices, bypass origin checks, impersonate others, or use Formerie in a way that creates security, deliverability, privacy, or abuse risk.
Delivery channels and integrations
Customers are responsible for configuring delivery channels, recipients, webhook endpoints, domains, templates, notification preferences, and integrations in a lawful and accurate way.
Formerie may reject, throttle, quarantine, retry, or disable delivery activity that appears abusive, unsafe, misconfigured, unlawful, or harmful to platform reliability. Delivery providers and third-party integrations may impose their own limits, rules, and availability constraints.
API and SDK use
You may use Formerie APIs and SDKs only as documented and within applicable rate limits, authentication rules, plan limits, and security requirements.
You must not reverse engineer non-public parts of the service, bypass access controls, probe tenant boundaries, scrape data, overload systems, interfere with service operation, or use tokens, keys, or credentials outside their intended scope.
Plans, billing, and limits
Paid features, usage limits, support levels, retention periods, custom domains, integrations, and other entitlements should be defined in the applicable plan, order form, or customer agreement.
Formerie may enforce plan limits and may suspend or limit features when usage exceeds limits, invoices are unpaid, activity creates risk, or continued service would violate these terms or applicable law.
Beta and preview features
Some features may be labeled beta, preview, experimental, or early access. These features may change, break, be limited, or be discontinued. They should not be used for critical production workflows unless Formerie has explicitly approved that use.
Security
Customers must promptly report suspected vulnerabilities, credential compromise, unauthorized access, abuse, or data incidents affecting their use of Formerie.
Formerie may investigate, suspend, limit, or remove access when necessary to protect the service, customers, public visitors, providers, or third parties.
Intellectual property
Formerie and its licensors retain ownership of the service, software, documentation, trademarks, designs, and other Formerie materials. These terms do not grant rights to use Formerie branding except as necessary to identify the service or as otherwise permitted in writing.
Customer content remains subject to the customer content section above.
Changes to the service
Formerie may update, improve, suspend, limit, or discontinue parts of the service as needed for security, reliability, legal, product, or operational reasons.
Where practical, Formerie should provide reasonable notice of material changes that negatively affect paid customers.
Disclaimers and liability
Production warranties, service levels, support commitments, indemnities, liability limits, and remedies should be defined in the applicable customer agreement. Do not rely on this starter public page as the final commercial legal agreement for paid production use.
Termination
Customers may stop using the service according to the applicable plan or agreement. Formerie may suspend or terminate access for material breach, abuse, security risk, non-payment, unlawful use, or other reasons stated in an applicable agreement.
After termination, customer content may be deleted, retained, exported, or archived according to the applicable agreement, retention settings, legal obligations, and backup practices.
